Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets the rules for using BenuCloud infrastructure and Services. It protects our network, our customers, and the wider internet. By using the Services, you agree to follow this AUP in full.

This AUP supplements and forms part of our Terms of Service. It should be read together with our Privacy Policy, Refund Policy, and Service Level Agreement. If there is a conflict, the order of precedence in the Terms applies (Terms → AUP → SLA → Refund → Privacy), unless a later written order states otherwise.

The AUP applies to all users of BenuCloud Services — including shared hosting, VPS, reseller accounts, and anyone accessing the network through your account (employees, contractors, clients, and end users). The account holder remains fully responsible for activity under the account.

1. Purpose & scope

We provide shared web hosting, VPS hosting, reseller hosting, and related support. This AUP explains what is allowed, what is prohibited, how we handle resource fairness and abuse, and what happens when rules are broken. Our goal is a stable, secure platform where legitimate sites can run without interference from harmful or abusive activity.

You must use the Services in compliance with all applicable local, national, and international laws — including those of Bangladesh and any country where your content is hosted or your audience is located.

The following content and activities are prohibited on BenuCloud infrastructure. This list is illustrative — similar or related misuse is also forbidden.

Due to security, load, and legal risk, the following (and similar) software is banned on shared and reseller platforms:

Use of nulled or pirated software may result in suspension or termination without refund, consistent with our Refund Policy.

3.4 High-risk or unsuitable workloads on shared hosting

Resource-intensive or isolated workloads should run on VPS, where resources are dedicated to your instance — still subject to this AUP and applicable law.

4. Email, spam & messaging abuse

We operate a zero-tolerance anti-spam policy. The following are strictly prohibited from our network:

Mass marketing email is allowed only where you have verifiable opt-in consent from recipients and comply with applicable anti-spam laws in every jurisdiction you target. You must honor unsubscribe requests promptly.

If your activity causes an IP address to be listed on a major spam blacklist, we may suspend the service immediately and may charge reasonable remediation costs. We use automated and manual monitoring to detect abuse; suspected spam accounts may be suspended pending investigation, with or without prior notice.

5. Resource fairness & “unmetered” use

Shared and reseller platforms share CPU, disk I/O, memory, and network capacity among many customers. “Unmetered” or “unlimited” marketing language — where used — means fair use for typical website workloads (sites, blogs, stores, and similar), not unrestricted consumption that harms neighbors.

VPS plans provide isolated resource envelopes described at checkout. You must still use those resources lawfully and must not attack other systems or our upstream network. Exceeding transfer or fair-use allowances may require an upgrade or temporary traffic limits.

We may isolate, suspend, or clean accounts that pose an active security risk to the platform. Related system and abuse logs may be processed as described in our Privacy Policy.

Violations may result in one or more of the following, depending on severity and risk:

We attempt to notify you before action where practical. We may act without prior notice when immediate mitigation is required to protect the network, other customers, or legal compliance — without liability for resulting disruption, as set out in the Terms.

Accounts terminated for AUP or Terms violations are not eligible for refunds, including unused prepaid time. See our Refund Policy.

11. Reporting abuse

If you believe our network or a site we host is being used for illegal or abusive activity, please report it promptly:

Include URLs, IP addresses, timestamps, headers, and any evidence you can share. We review reports in a timely manner and may suspend or terminate confirmed violators. Personal data in abuse reports is handled under our Privacy Policy.

12. Changes to this AUP

We may update this Acceptable Use Policy at any time. Changes will be posted on this page. Material updates may also be communicated via the client area or email on file. Continued use of the Services after an update constitutes acceptance of the revised AUP.
